Chapter 1 General Provisions
Article 1
In order to protect the copyright of the authors of literary and artistic works, as well as the rights and interests related to copyright, encourage the creation and dissemination of works that are beneficial to the construction of socialist spiritual civilization and material civilization, and promote the development and prosperity of socialist culture and scientific undertakings, this Law is formulated in accordance with the Constitution.
Article 2
Works of Chinese citizens or other organizations, whether published or not, enjoy copyright in accordance with this Law. The works of a stateless person of a foreigner shall be protected by this Law in accordance with the copyright of the State of the Author or the country of frequent residence and China, or international treaties jointly participated in. If the works of a stateless person of a foreigner are first published in China, they shall enjoy copyright in accordance with this Law. If the works of a stateless person of a country that has not signed an agreement with China or jointly participated in the international treaty and the stateless person of a stateless person of a first publication in the member state of an international treaty that China participates in, or are published simultaneously in member states and non-member states, they shall be protected by this Law.
Article 3
The works referred to in this Law include works such as literature, art, natural science, social science engineering and technology created in the following forms: (1) writing works; (2) oral works; (3) music, drama, folk art, dance, acrobatic art works; (4) fine arts and architectural works; (5) photography works; (6) film works and works created by methods similar to filming movies; (7) graphic works and model works such as engineering design drawings, product design drawings, maps, and diagrams; (8) computer software; (9) other works stipulated by laws and administrative regulations.
Article 4
When copyright holders exercise copyright, they shall not violate the Constitution and laws, nor shall they harm public interests. The state supervises and manages the publication and dissemination of works in accordance with the law.
Article 5
This Law does not apply to: (1) laws and regulations, decisions and orders of state organs and other documents with legislative, administrative and judicial nature, and their official translations; (2) Current affairs news; (3) General tables and formulas of common numbers in the calendar.
Article 6
The State Council shall stipulate separately the copyright protection measures for folk literature and art works.
Article 7
The copyright administrative department of the State Council is in charge of copyright management across the country; the copyright administrative department of the people's governments of autonomous regions and municipalities directly under the Central Government is in charge of copyright management in their administrative regions.
Article 8
The copyright owner and the copyright-related right holder may authorize the copyright collective management organization to exercise copyright or copyright-related rights. After the copyright collective management organization is authorized, it can claim rights for the copyright owner and the copyright-related right holder in its own name, and can act as parties to carry out litigation and arbitration activities involving copyright or copyright-related rights. The copyright collective management organization is a non-profit organization, and its establishment method is subject to the collection and distribution of copyright licensing fees, as well as supervision and management of it, etc., shall be separately stipulated by the State Council.
Chapter 2 Copyright
Article 9
The copyright holders include: (1) the author; (2) other citizen legal persons or other organizations that enjoy copyright in accordance with this Law.
Article 10
Copyright includes the following personal rights and property rights: (1) right to publish, that is, the right to decide whether the work is made public; (2) right to sign, that is, the right to indicate the author's identity and sign on the work; (3) right to modify, that is, the right to modify or authorize others to modify the work; (4) right to protect the completeness of the work, that is, the right to protect the work from distortion and tampering; (5) right to copy, that is, the right to make one or more copies of the work by printing, copying, recording, video, ripping, and remake; (6) right to distribute, that is, the right to provide the original or copy of the work to the public by selling or giving away; (7) renting
Right, that is, the right to license others to temporarily use film works and works created by similar films for a fee, except that computer software is not the main subject for rent; (8) Exhibition rights, that is, the right to publicly display originals or copies of photographic works of art works; (9) Performance rights, that is, the right to publicly perform works and publicly broadcast performances of works by various means; (10) Projection rights, that is, the right to publicly reproduce art photography movies and works created by similar films through technical equipment such as projectors and slide machines; (11) Broadcast rights, that is, to publicly reproduce art photography movies and works created by similar films; (11) Broadcast rights, that is, to publicly disclose them in wireless manner
The right to broadcast or disseminate works, to disseminate works broadcast to the public through wired or relay, and to disseminate works broadcast to the public through loudspeakers or other similar tools that transmit symbolic sound images; (12) The right to disseminate works on the public through wired or wireless means, so that the public can obtain works at the time and place they choose; (13) The right to film, that is, the right to make movies or fix works on the carrier in a similar way to filming movies; (14) The right to adapt, that is, the right to change works and create original new works;
(15) Translation rights, that is, the right to convert a work from one language to another; (16) Assembly rights, that is, the right to collect the work or fragments of the work into a new work through selection or arrangement; (17) Other rights that should be enjoyed by the copyright owner. The copyright owner may permit others to exercise the rights stipulated in items (5) to (17) of the preceding paragraph and obtain remuneration in accordance with the agreement or relevant provisions of this Law. The copyright owner may transfer the rights stipulated in items (5) to (17) of this article in whole or in part, and obtain remuneration in accordance with the agreement or relevant provisions of this Law.
Article 11
The copyright belongs to the author, except as otherwise provided in this Law. The citizen who creates the work is the author. Works that are presided over by the legal person or other organization, created on behalf of the will of the legal person or other organization, and bear the responsibility by the legal person or other organization, shall be deemed to be the author. If there is no proof to the contrary, the legal person or other organization signed on the work is the author.
Article 12
The copyright of works produced by adapting, translation, annotation and sorting of existing works is enjoyed by the adapter, translation, annotation and sorting of the author, but the copyright of the original work shall not be infringed when exercising the copyright.
Article 13
The copyright of works created by more than two people is shared by the co-created author. Those who do not participate in the creation cannot become the co-created author. If the cooperative works can be used separately, the author can enjoy the copyright of the parts they create separately, but the copyright of the overall copyright of the cooperative works shall not be infringed upon exercising copyright.
Article 14
Works that compile fragments of several works or data or other materials that do not constitute the work, and whose contents are selected or arranged to reflect originality are compiled works, and their copyrights are enjoyed by the compiler, but when exercising copyrights, the copyright of the original work shall not be infringed.
