Article 46

When broadcasting video works by TV stations and video works created by similar film production methods, they shall obtain permission from the producer or video producer and pay remuneration; when broadcasting video works by other people, they shall also obtain permission from the copyright owner and pay remuneration.

Chapter 5 Legal Liability and Law Enforcement Measures

Article 47

Article 48

Article 49

If the actual losses of the right holder or the illegal gains of the infringer cannot be determined, the people's court shall rule to give compensation of less than 500,000 yuan based on the circumstances of the infringement.

Article 50

If the copyright holder or the copyright owner has evidence to prove that others are committing or are about to commit acts that infringe on their rights, if they fail to stop it in a timely manner, it will cause irreparable damage to their legitimate rights and interests, they may apply to the people's court to take measures to order the relevant behaviors and property preservation before filing the lawsuit. The people's court shall apply to the provisions of Articles 93 to 96 and 99 of the Civil Procedure Law of the People's Republic of China.

Article 51

In order to stop infringement, when the evidence may be lost or difficult to obtain in the future, the copyright holder or the right holder related to the copyright may apply to the people's court for preservation before suing the lawsuit. After the people's court accepts the application, it must make a ruling within 48 hours; if the ruling is taken to take preservation measures, the execution shall be started immediately. The people's court may order the applicant to provide a guarantee, but if the applicant does not provide a guarantee, the application shall be rejected. If the applicant does not file a lawsuit within 15 days after the people's court takes preservation measures, the people's court shall lift the preservation measures.

Article 52

When a people's court hears a case, if it infringes on copyright or rights related to copyright, it may confiscate infringing copies of illegal gains and property that engages in illegal activities.

Article 53

If the publisher and producer of the replica cannot prove that the publishing and production is legally authorized, the publisher of the replica or the lessor of the replica of the replica of the computer software recording and video products created by similar film production methods cannot prove that the replica of the replica has a legal source, he shall bear legal liability.

Article 54

If the parties fail to perform contractual obligations or perform contractual obligations in the event of the agreement, they shall bear civil liability in accordance with the General Principles of the Civil Law of the People's Republic of China, the Contract Law of the People's Republic of China and other relevant laws.

Article 55

Copyright disputes can be mediated, or they can apply for arbitration from the arbitration institution based on written arbitration agreements reached by the parties or arbitration clauses in the copyright contract. If the parties do not have a written arbitration agreement and do not enter into an arbitration clause in the copyright contract, they can file a lawsuit directly with the people's court.

Article 56

If the parties are dissatisfied with the administrative penalty, they may file a lawsuit with the people's court within three months from the date of receipt of the administrative penalty decision. If the time limit does not file a lawsuit and fails to perform it, the copyright administrative department may apply to the people's court for execution.

Chapter 6 Attachment

Article 57

The copyright referred to in this law is copyright.

Article 58

Publication referred to in Article 2 of this Law refers to the copying and distribution of works.

Article 59

The protection measures for the right to disseminate computer software information networks shall be separately stipulated by the State Council. Infringement or breach of contract that occurs before the implementation of this Law shall be handled in accordance with the relevant provisions and policies when the infringement or breach of contract occurs.

Article 60

If the copyright owner and publisher, performer, recorder, video producer, radio station, and television station stipulated in this Law has not exceeded the protection period stipulated in this Law on the date of its implementation, it shall be protected in accordance with this Law.

Article 61

This Law shall come into force on June 1, 1991.

Article 44

Radio and television stations may broadcast published phonographs without permission from the copyright owner, but shall pay remuneration. Except where the parties have otherwise agreed. The specific measures shall be stipulated by the State Council.
